Husband and wife brought action against village and village police department alleging husband's arrest and wife's resulting loss of consortium constituted deprivation of their civil rights prohibited by federal statute. On defendants' motion to dismiss, the District Court, Leighton, J., held that: (1) right to consortium was not within spectrum of interests guaranteed by the Constitution or federal law; (2) the claim for loss of consortium was neither ancillary nor pendent to husband's claim; and (3) existence of type of detention room in which husband was placed sufficiently demonstrated a general policy of deliberate indifference on part of defendants to withstand defendants' motion to dismiss. Motion granted in part and denied in part. |
